Terms of Service

DugoutOps is a game-day operating system for baseball and softball teams. It lets coaches score games, livestream, track pitch counts and statistics, and generate highlight clips, and lets parents and followers watch games and access highlights.

Teams also get a public page on our website showing the team’s schedule, opponents and results. It contains no player names, photos or statistics, and a coach can turn it off in Team Settings → Discovery. See the Privacy Policy for what it publishes.

You must be at least 18 years old to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date.

If you enter information about players or other people (for example, your team roster), you confirm you have the authority to do so, including, for minors, the rights of a coach or guardian.

• Subscriptions renew automatically until canceled. You can cancel anytime; cancellation stops future renewals and takes effect at the end of the current billing period.
• Web purchases are processed by Stripe. Promotional rates, where offered, apply for the stated promotional period.
• Mobile purchases (subscriptions and à la carte content) are processed through Apple’s App Store or Google Play, and are subject to those stores’ terms.
• Refunds. Except where required by law, subscription fees are non-refundable. Refunds for in-app purchases are handled by Apple or Google under their respective policies; refunds for web purchases are handled through Stripe. We do not separately process refunds for store-billed purchases.
• Delivered digital items. Individual clips, reels, and recaps are delivered immediately and can be downloaded and kept. Because of that they are non-refundable once delivered, except where required by law or where delivery itself failed — a video that never rendered, or one that will not play. If a purchase is refunded by Apple, Google, or Stripe, access to the hosted copy ends; any file already saved to your device remains yours.

You retain ownership of the content you create or upload — livestreams, clips, reels, photos, rosters, and statistics (“Your Content”). You grant DugoutOps a worldwide, non-exclusive license to host, store, process, display, and deliver Your Content for the purpose of operating and providing the Service to you and the people you share it with.

You are responsible for Your Content and confirm you have the rights necessary to share it, including the consent of others who appear in your videos or photos where required.

Team information is published more widely than Your Content. While a team’s public page is switched on, the team name, schedule, opponents and results are displayed publicly and may be indexed by search engines — not only to the people you share them with. Player names, photos and statistics are never included. A head coach can switch the page off at any time.

Team messaging is available to team staff and to parents or guardians linked to a player on that team. It is not available to other followers.

• What you can send. Each team has one team chat that everyone eligible on the team can post in, a separate room for that team’s head and assistant coaches, and direct messages between a coach and a family or between coaches. Private messaging between two families is not offered.
• Reporting and blocking. Anyone in a conversation can report a message to that team’s coaches, and can block another person so they stop seeing that person’s messages. Blocking does not affect team announcements.
• Automatic filtering. Messages are checked before they are sent. Profanity, slurs and sexually explicit content are refused — the message is not delivered, and the sender is told why. Threatening language may still be delivered but is flagged for your team’s coaches to review, because whether it is a threat usually depends on context a filter cannot see. No filter catches everything, and this one does not read your messages for any other purpose.
• Moderation. A team’s coaches can review reported and flagged messages, remove a message from the team, and remove a person from that team’s chat. Coaches cannot remove other coaches from chat; contact us instead.
• Retention. Messages are deleted approximately 90 days after they are sent. If you delete your account, your messages are anonymized rather than removed, so the other side of a conversation keeps its context.

Messaging is a convenience for team business, not a records system. Do not use it for anything you need to keep.

You agree not to:

• Use the Service to break the law or infringe anyone's rights.
• Upload content that is unlawful, harassing, hateful, or that you don't have the rights to share.
• Harass, bully, threaten, or send obscene or abusive messages to anyone in team messaging.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
• Resell or commercially exploit the Service without our written permission.

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice with the details required by the DMCA to support@dugoutops.com. We will respond to valid notices and may remove infringing content and terminate repeat infringers.

You can stop using the Service and delete your account at any time, in the mobile app (Settings → Delete Account) or on the web at dugoutops.com/delete-account. We may suspend or terminate accounts that violate these Terms or that create risk for the Service or other users.

The Service is provided “as is” without warranties of any kind. We do not guarantee the Service will be uninterrupted, error-free, or that statistics, streams, or highlights will be complete or accurate.

To the fullest extent permitted by law, Lumvre LLC and its affiliates will not be liable for indirect, incidental, special, or consequential damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in California.

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above and, for material changes, notify you by email or in-app. Continued use after changes take effect means you accept the updated Terms.
